We advised on planning strategy in order to secure the client's objectives of a relocated, larger foodstore and wider comprehensive mixed-use development. A flexible mixed-use permission was secured, comprising 10 development plots and maximum floorspace and height parameters to allow flexibility in the final design.
Our role in the process included submission of an outline planning application supported by a retail capacity/ impact assessment; design & access statement; and co-ordination of a complex environmental statement. We were also extensively involved in the negotiation of the S106 Agreement which included a reduced affordable housing component.
The strategic nature of the scheme required extensive negotiations with the local authority, statutory consultees and other stakeholders including local interest groups. This led to a general acceptance of the scheme and recognition of the wider regeneration benefits for the shopping centre, surrounding area and nearby regional hospital and university whilst protecting the client's interests and objectives.
The local authority resolved to grant planning permission for the scheme within 6 months. The planning application was referred to the Secretary of State and not called-in.
