Planning Tips for Asset Management - Flexible Planning Permissions (Feb 2009)

In 1988 the General Permitted Development Order (GPDO) introduced a provision to give greater scope in the marketing of vacant premises. Effectively, what we know as the ‘Class E’ provision allows that where planning permission has been granted for two or more uses of the same set of premises within the same planning permission, then those uses can be switched backwards and forwards any number of times within the ten year period following the grant of permission.

Planning Tips for Asset Management - Expiry of Permissions (Feb 2009)

Since August 2005, the vast majority of planning permissions have been issued subject to the default three year time period for commencement. There are also still unimplemented permissions on 5 year commencement conditions dating from 2004 and 2005 which also demand close review. With fewer developments currently proceeding serious consideration needs to be given to preserving the benefit of these permissions for more conducive times.
